FAQ
About Us & Our Paid Resources
-
Nanny Toolkit creates practical, professionally designed resources for nannies and their employers. Our goal is to make it easier to establish clear expectations, document important employment terms, and navigate the working relationship with greater confidence.
Resources include the Comprehensive Nanny Employment Agreement, specialized addenda, supporting forms, and educational materials designed specifically for nanny employment.
-
Nanny Toolkit resources are designed for both nannies and the families who employ them.
The Employment Agreement is intended to be completed collaboratively so both parties understand and agree to the terms of employment. Supporting resources may be useful to either party depending on the situation.
-
The Agreement includes 17 sections covering major aspects of the nanny employment relationship. While it includes with fill-in fields for easy usability, it is designed to be customized to the specific employment arrangement rather than used as a one-size-fits-all contract.
-
Not necessarily. Most paid resources have been reviewed and/or revised by a licensed attorney, except for the following Supporting Documents:
Child Information and Routine Sheet
Emergency Contact and Medical Information Sheet
Live-In Housing Inventory and Condition Record
Mileage and Expense Log, and
Travel & Overnight Care Information Sheet.
These forms were not submitted for attorney review because they are informational or recordkeeping tools and do not modify the terms of the Employment Agreement.
Attorney review does not mean that the Agreement has been customized for every state, city, household, or individual employment situation. State and local household-employment laws vary, so buyers should still confirm the requirements that apply where the nanny will work.
-
No. Nanny Toolkit LLC is not a law firm and does not provide legal, tax, or accounting advice.
Nanny Toolkit products are general-purpose educational and employment-planning resources. Purchasing or using a product does not create an attorney-client relationship with Nanny Toolkit LLC or with any attorney who reviewed a Nanny Toolkit product.
-
Yes. The Comprehensive Nanny Employment Agreement is designed as a nationwide general-purpose template and includes language intended to accommodate differences in federal, state, and local law.
However, it has not been customized for any particular jurisdiction. Requirements involving matters such as minimum wage, overtime, paid sick leave, workers’ compensation, domestic-worker protections, expense reimbursement, final pay, and workplace monitoring can vary by location.
The included Buyer’s Guide helps buyers identify important areas to research before signing the Agreement.
-
Nanny Toolkit does not require buyers to obtain attorney review before using the template.
Because employment laws and individual circumstances vary, however, the Employer and Nanny are encouraged to have their completed Agreement reviewed by an attorney licensed in the state where the work will be performed, particularly if they have questions about applicable law or unusual employment arrangements.
-
The Buyer’s Guide is a companion resource designed to help you complete the Employment Agreement thoughtfully and identify legal requirements that may need additional research.
It covers topics such as household-employee classification, payroll, minimum wage and overtime, paid sick leave, workers’ compensation, expense reimbursement, background screening, workplace monitoring, live-in employment, and other state- or local-specific requirements.
It also includes a Before You Sign State & Local Law Checklist to help buyers identify issues that should be addressed before finalizing the Agreement.
The Buyer’s Guide is educational and does not replace legal, tax, or payroll advice.
-
Yes. The Agreement is specifically designed to be customized.
Many provisions include selectable options, fill-in fields, and space for additional terms so the parties can document the arrangement that actually applies to them.
Any customization should still comply with applicable law. A contractual selection cannot waive a legal right or obligation that cannot lawfully be waived.
-
Addenda provide additional terms for employment arrangements that require more detail than the main Agreement alone.
Nanny Toolkit offers addenda for situations such as:
Nanny shares
Live-in nanny positions
Travel and overnight care
Relocation
Newborn, extended, or 24-hour care
Specialized medical care
Temporary changes to employment terms
An applicable addendum can be completed and incorporated into the main Employment Agreement.
-
No. Addenda are intended to be used only when they are relevant to the employment arrangement.
For example, a family hiring a standard live-out nanny who does not travel with the family would not need a Live-In Nanny Addendum or Travel & Overnight Addendum simply because those products exist.
-
Supporting forms help families and nannies document information and events that may arise during employment without adding everything directly to the employment contract.
Available resources include forms for areas such as emergency information, medical authorization, child routines, mileage and expenses, incident reporting, performance reviews, contract changes, employment separation, live-in housing, and travel.
Some supporting forms are records rather than contractual terms unless the parties specifically choose to incorporate them into the Agreement.
-
The Comprehensive Nanny Employment Agreement contains all 17 sections as one complete employment contract.
Individual sections are available for buyers who need help documenting a particular part of an existing employment arrangement without purchasing the full Agreement.
Individual sections are focused resources and are not a substitute for reviewing the employment arrangement as a whole. If an individual section is used with an existing agreement, the buyer should review it for consistency with the other contract terms, cross-references, and applicable law.
If you are establishing a new nanny employment relationship from the beginning, the complete Agreement provides the most comprehensive option.
-
No. The Employment Agreement is designed for direct-hire nanny employment.
It is not intended for J-1 Exchange Visitor au pair placements, which operate under a separate federal program with their own sponsor, compensation, scheduling, and program requirements.
-
The Comprehensive Agreement may be used as the base agreement for a nanny-share arrangement when paired with appropriate nanny-share terms.
A nanny share involves additional considerations beyond a standard one-family employment arrangement. Buyers using the Agreement for a nanny share should also use the Nanny Share Addendum and confirm any applicable payroll, joint-employment, wage-and-hour, insurance, and childcare-licensing requirements.
-
No. No nationwide template can guarantee compliance with every federal, state, and local requirement or account for every individual employment situation.
The Agreement is designed to provide a strong, customizable framework while directing buyers to confirm requirements that may vary by jurisdiction.
The Buyer’s Guide and state/local law checklist are included to help buyers identify those issues before signing.
-
Nanny Toolkit products are licensed for use according to the terms provided with the product. Purchasing a file does not transfer ownership of the underlying template or grant permission to redistribute, resell, publish, or otherwise share the product beyond the scope of the applicable license.
Please review the license terms included with your purchase for complete usage rights and restrictions.
-
Employment relationships often change over time.
The Agreement includes provisions for reviewing employment terms and documenting material changes. Depending on the situation, the parties may use a Contract Amendment or Temporary Change Addendum rather than completing an entirely new Agreement.
Changes involving compensation, schedule, responsibilities, work location, number of children, travel, or other significant terms should be documented when appropriate.
