Last Updated: October 14, 2026
These Website Terms of Use & Legal Disclaimers (“Terms”) govern your access to and use of nannytoolkit.com (the “Website”), which is owned and operated by Nanny Toolkit LLC (“Nanny Toolkit,” “we,” “us,” or “our”).
Please read these Terms carefully before using the Website or purchasing any Nanny Toolkit product.
By accessing or using the Website, purchasing a product, or otherwise interacting with Nanny Toolkit through the Website, you agree to be bound by these Terms and any additional policies or agreements that apply to your use or purchase.
If you do not agree to these Terms, please do not use the Website or purchase our products.

Nanny Toolkit LLC is a Kansas limited liability company.
Questions about these Terms may be directed to:
Nanny Toolkit LLC
Email: info@nannytoolkit.com
2. ELIGIBILITY
The Website is intended primarily for adults.
You must be at least 18 years old or the age of legal majority in your jurisdiction, whichever is greater, to make a purchase from Nanny Toolkit.
By purchasing a product, you represent that you have the legal capacity to enter into a binding agreement.
3. OTHER POLICIES AND AGREEMENTS
These Terms should be read together with other policies and agreements made available through the Website, including our:
Privacy Policy;
Digital Product License Agreement;
refund or cancellation policies, if separately posted;
product-specific terms or notices; and
any other policies incorporated by reference.
Product License Agreement
The use, copying, modification, distribution, resale, and other use of purchased Nanny Toolkit digital products is governed by the Nanny Toolkit Digital Product License Agreement applicable to the product.
Purchasing a Nanny Toolkit product does not transfer ownership of the underlying intellectual property to the purchaser.
3.1 Order of Precedence
The Nanny Toolkit Digital Product License Agreement, the Website Terms of Use & Legal Disclaimers, and any product-specific terms are to be read together where reasonably possible. If they conflict: (a) product-specific terms control as to that Product; (b) the Digital Product License Agreement controls as to the ownership, copying, use, sharing, and redistribution of the Products, and as to the Licensee’s remedies and Nanny Toolkit’s liability relating to the Products; and (c) the Website Terms of Use & Legal Disclaimers control as to the Website, orders, delivery, and all other matters. Nothing in this section overrides a right that cannot lawfully be waived.
4. IMPORTANT LEGAL DISCLAIMER
4.1 Nanny Toolkit Is Not a Law Firm
Nanny Toolkit LLC is not a law firm and does not provide legal services.
Neither Nanny Toolkit nor the Website is a substitute for advice from a qualified attorney.
The purchase, download, access, completion, customization, or use of any Nanny Toolkit product does not create an attorney-client relationship between you and:
Nanny Toolkit LLC;
any owner, employee, contractor, contributor, or representative of Nanny Toolkit;
any attorney who has reviewed or revised a Nanny Toolkit product; or
any other person or entity associated with Nanny Toolkit.
4.2 No Legal Advice
Nanny Toolkit products and Website content are provided for general informational and educational purposes and as customizable resources.
Nothing on the Website or contained in a Nanny Toolkit product constitutes individualized:
legal advice;
tax advice;
accounting advice;
payroll advice;
human-resources advice;
employment-law advice; or
other professional advice.
Information concerning laws, employment practices, compensation, benefits, taxes, contracts, household employment, or other legal or regulatory topics is general in nature and should not be relied upon as a substitute for advice regarding your individual circumstances.
You should consult an appropriately qualified professional regarding questions specific to your situation.
4.3 Communications With Us
Contacting Nanny Toolkit, including by email, does not create an attorney-client relationship. Our staff cannot give legal advice or tell you which provisions or options to select for your situation.
5. ATTORNEY-REVIEWED PRODUCTS
Certain Nanny Toolkit products may be described as “reviewed by a licensed attorney,” “reviewed and revised by a licensed attorney,” or similar language.
Such a statement means that a licensed attorney reviewed or reviewed and revised the identified resource as part of Nanny Toolkit's product-development process.
It does not mean that:
the reviewing attorney represents you;
you have entered into an attorney-client relationship with the reviewing attorney;
the attorney has reviewed your particular circumstances;
the attorney has determined that the product complies with the laws of your particular state, city, county, or other jurisdiction;
the attorney has approved any changes or customizations you make to the product;
the document is guaranteed to be legally enforceable;
use of the document guarantees a particular legal result; or
the document eliminates the need for individualized legal advice.
A statement that a product was reviewed by a licensed attorney is not an endorsement, certification, or guarantee, does not mean the attorney is licensed in your state, and applies only to the version identified by the product’s version and review date. A customized or modified document has not been reviewed by any attorney.
Only products specifically identified by Nanny Toolkit as attorney-reviewed or attorney-reviewed and revised should be understood to have undergone such review.
The fact that one Nanny Toolkit product was reviewed by an attorney does not mean that all Nanny Toolkit products were reviewed by an attorney.
6. JURISDICTIONAL AND EMPLOYMENT-LAW VARIATIONS
Nanny Toolkit resources may be designed for broad use within the United States, but laws affecting nanny and household employment can vary significantly among states and local jurisdictions.
Applicable requirements may include, without limitation:
minimum-wage laws;
overtime requirements;
domestic-worker protections;
paid sick-leave requirements;
paid family or medical leave;
meal and rest-break requirements;
workers' compensation requirements;
unemployment-insurance requirements;
payroll and tax obligations;
wage-notice and pay-statement requirements;
reimbursement requirements;
anti-discrimination and anti-harassment laws;
recordkeeping requirements;
employment-contract restrictions;
privacy and monitoring laws;
vehicle and insurance requirements; and
other state or local employment rules.
A provision that is appropriate or enforceable in one jurisdiction may not be appropriate or enforceable in another.
You are responsible for determining which federal, state, and local laws apply to your employment relationship and for appropriately customizing any Nanny Toolkit resource.
Nanny Toolkit does not guarantee that any product is compliant with every law applicable to every purchaser or employment arrangement.
7. LAWS AND INFORMATION MAY CHANGE
Laws, regulations, agency guidance, industry practices, and professional standards can change over time.
Although we may periodically revise our products or Website content, Nanny Toolkit does not guarantee that every resource will reflect the most recent legal or regulatory development at every moment.
A product's availability for purchase does not constitute a representation that no relevant law has changed since the product was created, reviewed, revised, or last updated.
You are responsible for confirming current legal requirements applicable to your circumstances.
8. CUSTOMIZATION OF TEMPLATES
Many Nanny Toolkit products are intended to be customized.
You are responsible for:
reviewing the entire product before using it;
selecting provisions appropriate to your situation;
completing all necessary fields;
deleting provisions that do not apply;
adding provisions required by your circumstances or applicable law;
resolving inconsistent selections or provisions;
obtaining any required signatures or acknowledgments; and
seeking professional advice when appropriate.
Nanny Toolkit is not responsible for errors, omissions, inconsistencies, or unintended effects resulting from a purchaser's modification, completion, combination, or use of a template.
Nanny Toolkit products are designed for direct-hire household employment. They are not designed for J-1 au pair placements, agency placements, or employment by a business.
9. NO GUARANTEE OF RESULTS
Nanny Toolkit does not guarantee any particular result from using our Website, products, templates, forms, guides, or educational content.
For example, we do not guarantee that use of a Nanny Toolkit resource will:
prevent an employment dispute;
prevent termination of employment;
ensure compliance with every applicable law;
cause a party to fulfill contractual obligations;
prevent litigation;
make every contractual provision enforceable;
result in successful negotiation;
produce a particular employment relationship; or
produce any particular financial, professional, or legal outcome.
Individual circumstances and applicable laws vary.
10. EDUCATIONAL AND BLOG CONTENT
Articles, blog posts, guides, checklists, examples, explanations, and other educational content available through the Website are provided for general informational purposes.
Such materials may simplify complex topics and are not intended to provide a complete statement of applicable law or professional practice.
Examples and hypothetical scenarios are illustrative only.
You should not assume that information applicable to another nanny, family, employer, employee, or jurisdiction applies to your circumstances.
11. PURCHASES
When you place an order through the Website, you agree to provide accurate, complete, and current information necessary to process the transaction.
We reserve the right, subject to applicable law, to:
refuse or cancel an order;
limit quantities;
correct pricing or product-description errors;
discontinue a product;
update a product; or
restrict purchases where we reasonably suspect fraud, unauthorized payment activity, misuse, or violation of these Terms or the Product License Agreement.
If we cancel a paid order before providing the purchased product, we will provide any refund required under applicable law or our applicable policies.
12. PRICING AND PAYMENT
Prices are displayed on the Website in the currency indicated at checkout.
Nanny Toolkit may change product prices at any time. A later price change does not entitle a previous purchaser to a refund or price adjustment unless otherwise expressly stated.
Payments are processed through Squarespace Payments and its applicable payment-service providers.
By submitting payment information, you represent that you are authorized to use the payment method provided and authorize the applicable amount, including any properly disclosed taxes or charges, to be processed.
Nanny Toolkit does not ordinarily receive or store complete payment-card numbers through the standard Squarespace checkout process.
13. DIGITAL PRODUCT DELIVERY
Nanny Toolkit products are primarily digital products delivered electronically.
You are responsible for:
providing an accurate email address at checkout;
downloading or accessing purchased files within any applicable access period;
saving appropriate backup copies of files you are permitted to retain; and
ensuring your device has software capable of opening the purchased file format.
Unless expressly stated otherwise, purchasing a digital product does not guarantee permanent or indefinite access to any particular online download link. Download links may expire and, where supported by our delivery platform, may be automatically renewed or reissued.
Purchased files will remain available for renewed download access for at least twelve (12) months after purchase. During that period, customers may use any available automated link-renewal process or contact Nanny Toolkit to request a replacement download link or other reasonable means of accessing their purchased files.
Expiration of download access does not terminate an otherwise valid license to copies of the Product previously downloaded by the Licensee.
Nanny Toolkit may change its Website, hosting provider, delivery method, or product catalog over time.
14. REFUNDS AND DIGITAL PRODUCTS
Because Nanny Toolkit products are digital resources that may be accessed, downloaded, copied, or saved immediately after delivery, digital-product purchases are generally final and non-refundable once access or delivery has been provided, except:
where a refund is required by applicable law;
where Nanny Toolkit expressly states otherwise;
where the purchaser was charged incorrectly;
where a duplicate charge occurred; or
where Nanny Toolkit determines, in its discretion, that a refund is otherwise appropriate.
Nothing in these Terms waives any non-waivable consumer right or remedy provided by applicable law.
If you experience a technical issue receiving or accessing a purchased file, contact info@nannytoolkit.com so that we can attempt to resolve the issue.
15. PRODUCT UPDATES
We may revise or update Nanny Toolkit products from time to time.
Unless expressly stated otherwise at the time of purchase:
purchase of one version of a product does not guarantee free access to every future revision or edition;
we are not obligated to notify previous purchasers of every change in law or every product revision; and
continued access to future product versions is not included unless specifically offered.
If we choose to provide updates to previous purchasers, doing so does not create an obligation to provide future updates.
16. INTELLECTUAL PROPERTY
Unless otherwise indicated, the Website and its contents are owned by or licensed to Nanny Toolkit LLC and are protected by applicable copyright, trademark, and other intellectual-property laws.
Protected materials may include:
digital products;
contract templates;
addenda;
forms;
worksheets;
guides;
written Website content;
blog posts;
product descriptions;
graphics;
illustrations;
photographs owned by or licensed to Nanny Toolkit;
branding;
logos;
page layouts; and
other original material.
Except as expressly permitted by applicable law or the applicable Product License Agreement, you may not reproduce, redistribute, publish, sell, sublicense, commercially exploit, or create unauthorized derivative works from Nanny Toolkit content.
17. NANNY TOOLKIT BRANDING
The Nanny Toolkit™ name, logo, branding, product names, graphics, and related brand identifiers are the property of Nanny Toolkit LLC to the extent protected by applicable law.
Nothing on the Website grants you permission to use Nanny Toolkit branding in a manner that suggests sponsorship, approval, affiliation, partnership, or endorsement without our prior written permission.
18. PROHIBITED USES
You may not use the Website or Nanny Toolkit content to:
violate any applicable law or regulation;
infringe intellectual-property or other rights;
distribute malicious software or code;
interfere with the security or operation of the Website;
attempt to gain unauthorized access to the Website, accounts, systems, or data;
impersonate another person or entity;
misrepresent your affiliation with Nanny Toolkit;
scrape, harvest, or systematically extract Website content or products for unauthorized commercial purposes, or use Website content or products to train or evaluate artificial-intelligence or machine-learning models;
use automated systems to access the Website in a manner that imposes an unreasonable burden on the Website;
circumvent access restrictions or security measures;
resell or redistribute products contrary to the applicable Product License Agreement;
remove copyright, trademark, licensing, or proprietary notices, except as expressly permitted by Section 5.5 of the Digital Product License Agreement; or
use Nanny Toolkit products or branding in a fraudulent, deceptive, unlawful, or misleading manner.
We reserve the right to restrict access to the Website or refuse service where we reasonably believe these Terms or another applicable agreement have been violated.
19. INFORMATION ENTERED INTO DOWNLOADED DOCUMENTS
Some Nanny Toolkit products contain fields in which customers may enter personal, employment, financial, medical, emergency, or other sensitive information about themselves or others.
After a product has been downloaded, you are responsible for the information you enter into the document and for how the completed document is stored, transmitted, accessed, and shared.
Nanny Toolkit does not automatically receive information that you enter into a downloaded file simply because the file originated from Nanny Toolkit.
You should use reasonable security measures when storing or transmitting documents containing sensitive information.
20. CUSTOMER COMMUNICATIONS AND FEEDBACK
If you contact Nanny Toolkit, you are responsible for ensuring that information you provide is lawful and does not violate the rights of another person.
Please do not send confidential legal documents, sensitive health information, Social Security numbers, complete financial-account information, or other highly sensitive information unless specifically requested and reasonably necessary.
If you voluntarily provide suggestions, ideas, or general feedback concerning Nanny Toolkit's products or services, we may use that feedback to improve our business without obligation to compensate you, provided that we do not thereby obtain ownership of material you own that is separately protected by intellectual-property law.
21. REVIEWS AND TESTIMONIALS
The Website may display customer reviews, testimonials, or other statements concerning Nanny Toolkit products.
Individual experiences may vary.
A testimonial or positive review does not constitute a guarantee that another purchaser will have the same experience or achieve the same result.
Where required, material relationships associated with reviews, testimonials, endorsements, or promotional content will be disclosed.
22. THIRD-PARTY WEBSITES AND SERVICES
The Website may contain links to third-party websites, tools, platforms, products, or services.
These links are provided for convenience or informational purposes and do not necessarily constitute an endorsement.
Nanny Toolkit does not control and is not responsible for the:
content;
accuracy;
availability;
security;
privacy practices; or
terms of third-party websites or services.
Your use of a third-party service is governed by that third party's own terms and policies.
23. WEBSITE AVAILABILITY
We attempt to maintain a functional and accessible Website, but we do not guarantee that the Website will always be available, uninterrupted, secure, or error-free.
The Website may occasionally be unavailable due to:
maintenance;
updates;
technical problems;
hosting-provider issues;
security events;
circumstances outside our reasonable control; or
discontinuation or modification of Website features.
We may modify, suspend, or discontinue portions of the Website or particular products, subject to applicable law and any existing contractual obligations.
24. DISCLAIMER OF WARRANTIES
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, THE WEBSITE, WEBSITE CONTENT, AND NANNY TOOLKIT PRODUCTS ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS EXCEPT TO THE EXTENT A DIFFERENT EXPRESS WARRANTY IS PROVIDED IN WRITING.
NANNY TOOLKIT DOES NOT MAKE WARRANTIES OR REPRESENTATIONS THAT:
THE WEBSITE WILL BE UNINTERRUPTED OR ERROR-FREE;
EVERY PRODUCT WILL BE APPROPRIATE FOR EVERY USER OR JURISDICTION;
USE OF A PRODUCT WILL ENSURE LEGAL COMPLIANCE;
EVERY PROVISION IN A TEMPLATE WILL BE ENFORCEABLE IN EVERY JURISDICTION;
THE WEBSITE OR PRODUCTS WILL MEET EVERY PURCHASER'S PARTICULAR NEEDS; OR
INFORMATION WILL REMAIN CURRENT INDEFINITELY.
TO THE EXTENT PERMITTED BY LAW, WE DISCLAIM IMPLIED WARRANTIES THAT MAY OTHERWISE APPLY.
NOTHING IN THESE TERMS EXCLUDES, LIMITS, OR WAIVES A WARRANTY, RIGHT, OR REMEDY THAT CANNOT LAWFULLY BE EXCLUDED, LIMITED, OR WAIVED.
25. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Nanny Toolkit LLC and its owners, employees, contractors, agents, contributors, and representatives will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from or related to your use of, inability to use, or reliance on the Website or Nanny Toolkit products.
This may include, where permitted by law, damages arising from:
employment disputes;
contractual disputes;
lost income;
lost business opportunities;
lost data;
reliance on outdated or inapplicable information;
unauthorized sharing of completed documents by a purchaser or third party;
modifications made to a Nanny Toolkit template; or
failure to obtain individualized professional advice.
To the fullest extent permitted by applicable law, Nanny Toolkit's aggregate liability arising out of or relating to a particular purchased product will not exceed the amount you actually paid to Nanny Toolkit for that product.
For any product provided without charge, and for any claim not relating to a paid product, Nanny Toolkit's aggregate liability will not exceed $100.
These limitations apply only to the extent permitted by applicable law.
Nothing in these Terms limits liability that cannot lawfully be limited, including liability for fraud, gross negligence, or willful misconduct, or excludes any non-waivable consumer protection.
26. INDEMNIFICATION
To the extent permitted by applicable law, you agree to indemnify and hold harmless Nanny Toolkit LLC and its owners, employees, contractors, agents, and representatives from third-party claims, liabilities, losses, and reasonable expenses arising directly from your:
unlawful use of the Website or a Nanny Toolkit product;
unauthorized reproduction, resale, redistribution, or licensing of Nanny Toolkit intellectual property;
infringement of another person's rights;
material violation of these Terms; or
material violation of the applicable Product License Agreement.
This provision does not require you to indemnify Nanny Toolkit for claims resulting solely from Nanny Toolkit's own conduct where such indemnification is prohibited by law.
27. PRIVACY
Your use of the Website is also subject to the Nanny Toolkit Privacy Policy, which describes how personal information is collected, used, disclosed, and protected.
Please review the Privacy Policy before submitting personal information through the Website.
28. GOVERNING LAW
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles, except where applicable law requires otherwise.
Nothing in this provision deprives a consumer of a mandatory protection provided by the law of the consumer's jurisdiction that cannot lawfully be waived by contract.
28.1 Governing Law and Venue
These Terms are governed by the laws of the State of Kansas, without regard to conflict-of-law principles. Subject to any mandatory consumer-protection law that gives you the right to sue in your home jurisdiction, any lawsuit arising from or relating to these Terms must be brought in the state or federal courts located in Douglas County, Kansas, and you and Nanny Toolkit consent to the jurisdiction of those courts.
29. DISPUTES
If you believe there is a problem with a purchase or your use of the Website, we encourage you to contact us first at info@nannytoolkit.com so that we have an opportunity to address the issue.
Nothing in this section prevents either party from exercising a right or remedy available under applicable law.
These Terms do not currently require mandatory arbitration or waive a consumer's right to participate in a class action.
30. CHANGES TO THESE TERMS
We may revise these Terms from time to time to reflect changes in:
our Website;
products or services;
business practices;
technology;
service providers; or
applicable laws or regulations.
When these Terms are updated, the “Last Updated” date at the top of this page will be revised.
Changes apply prospectively from the date they become effective unless otherwise permitted by law.
Material changes to terms governing a purchase already completed will not retroactively alter the purchaser's rights unless legally permitted and appropriately agreed to.
31. SEVERABILITY
If any provision of these Terms is determined to be invalid, unlawful, or unenforceable, that provision will be enforced to the maximum extent permitted by law or severed as necessary, and the remaining provisions will remain in effect.
32. NO WAIVER
Our failure to enforce a provision of these Terms does not waive our right to enforce that provision or another provision in the future.
33. ASSIGNMENT
You may not assign or transfer your rights or obligations under these Terms in a manner that would circumvent the Product License Agreement or other applicable restrictions.
Nanny Toolkit may assign its rights and obligations in connection with a merger, acquisition, reorganization, sale of the business or assets, or similar transaction, subject to applicable law.
